We just have to remember that this conversation is about the absurdity of this word being trademarked, it's not a bash-fest against the company.
My feeling is that the problem occurred at the administrative level...there is no blaming the guy for wanting his company name trademarked, the problem stems from the folks that allowed it to happen without giving any thought to the fact that the word has been used for years!

I feel that if this company chose to attempt to squash the use of their "orchidarium" term legally, it would be thrown out of court and their trademark revoked. It was clearly granted to them by someone not at all familiar with the word and the fact that it is a common-place term, and has been for many years before this company popped up. They did not invent the "orchidarium", and therefore have no right to the trademark! People have been building "orchidariums" (and calling them as such) LONG before this company decided to try to corner the market by an underhanded move, trademarking the commonly used term for a tank or enclosure in which one grows orchids.
My opinion is to have no fear and use the term. This cowardly fool hasn't come back to defend his PM. I think it was a scare tactic, and they know darn well they can't back it up. It is pathetic that anyone has to be scared to used the term, or even take seriously for one moment this guy's PM. Generic terms are not protected by trademark law, and orchidarium is a generic term.

While I agree with you...my loyalty is to the safe-keeping of Orchidboard.
I have no idea what, if any, repercussions could affect this forum and because of that lack of knowledge, I suggest we not allow this thread to become a source of negativity.
The fact is this...they have the trademark and have asked that it not be used to describe the boxes we grow our orchids in.
I say we can get along without that word...our members have come up with some great replacements already!

The people on this board are talented and can come up with something better anyways!!
So far there have been a lot of good suggestions .. Question is - which one do we pick?

I agree Sue....we shouldn't get negative and we should all just get along...life is to short to let the little things in life bother you. I did have superb service while setting up my orchidarium...I was able to call for help at 7 or 8 pm in the evening and one of the owners helped walk me and my hubby through setting it up....
