yes indeed litigaion is rampant.The original term I believe for a Terarium was a "Wardian case" and was commonly used in Victorian times.Here is a link to a wikipedia article about them

Myself I think I its just petty to be nit picking about people using the term if they arent using it commercially. I will be sure to never buy a commercial product that uses that name now just to be sure their trademark is not infringed in any way.

Angry "Orchidarium" trademark

I'm no expert, but it looks to me as though your precious trademark is actually the work "orchidarium" with a line under it and "Wardian Cases" under that. The typed word "Orchidarium" is only the reference to the mark entitled "Orchidarium".

I shall continue to hoover, use Durex when necessary, pass a friend with hayfever a Kleenex, make myself a Pimms (using the cheat's recipe) to watch the tennis, stick everything with Selotape, and not worry too much about orchidariums (surely orchidaria?) - life is too short. Wardian is easier to type though!

As an owner of a registered trademark, I might offer some input here...

First, RT is as good as the owner is willing to spend to defend it. Basically the owner may just be blowing smoke up your rear ends.

Sencondly, they can be easily contested by "first use". If someone used it in an article before they trademarked it, thier TM is useless.

And thirdly, is he really gonna pursue all of us for using it?

And lastly, once he files, all you have to do is stop using the term :cease and desist:. No harm, no foul BUT, he has to serve you first.

So with that in mind...

Hi, I read all the posts of this thread and I remembered something I saw doing some reserch not long ago. I just wanted to show you this site, I believe it is not the same company, so we can all feel free to use the word orchidarium to refer to a glass box with orchids in it
